Welcome to Recaptu (https://recaptu.com). By accessing or using our platform, web applications, or related creative generation services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.


1. Description of Service

Recaptu provides an AI-assisted SaaS platform enabling businesses, marketers, and e-commerce merchants to create promotional assets, advertising banners, product mockups, and short-form video creatives from uploaded product imagery.


2. Accounts and Security

  • You must provide accurate, complete, and current information when creating an account.
  • You are solely responsible for safeguarding your login credentials and for all activities that occur under your account.
  • You must immediately notify Recaptu of any unauthorized use or security breach related to your account.

3. User Content and Intellectual Property

  • Source Content Ownership: You retain all intellectual property rights in the product photographs, trademarks, logos, and materials you upload to Recaptu. By uploading content, you grant Recaptu a non-exclusive, worldwide, royalty-free license to use, host, and process such content solely to provide the generation services to you.
  • Generated Assets and Commercial Use: Subject to your compliance with these Terms and an active, paid subscription (or applicable plan terms), you receive the right to download and use the generated visual assets for legitimate commercial, marketing, and advertising purposes.
  • AI Nature of Output: You acknowledge that generative AI models may produce outputs similar to materials generated for other users based on similar prompts or settings. Recaptu does not warrant that generated outputs will be unique or eligible for exclusive trademark registration.

4. Acceptable Use Policy

You agree not to use Recaptu to generate, upload, or distribute content that:

  • Infringes upon any third party’s intellectual property, patent, trademark, or privacy rights.
  • Contains defamatory, hateful, sexually explicit, abusive, or unlawful material.
  • Attempts to reverse engineer, decompile, scrape, or disrupt the platform infrastructure, API, or databases.
  • Uses automated scripts, bots, or scrapers to access or extract data from the service without express permission.

5. Subscriptions, Payments, and Cancellations

  • Billing: Paid plans, generation quotas, and recurring subscriptions are billed in advance in accordance with the pricing tiers published on our Pricing page.
  • Cancellations: You may cancel your subscription at any time via your account dashboard. Cancellation takes effect at the end of the current paid billing cycle.
  • Refunds: Due to the immediate computing costs associated with AI processing, payments are non-refundable unless required by applicable consumer protection laws or explicitly stated otherwise.

6. Third-Party Services and APIs

The platform integrates third-party cloud infrastructure and machine learning providers. We do not control and are not liable for third-party service interruptions, upstream API deprecations, or platform-level changes outside our reasonable control.


7. Disclaimer of Warranties and Limitation of Liability

Recaptu is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or that generated creatives will meet all specific marketing outcomes or campaign goals.

To the maximum extent permitted by applicable law, Recaptu and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill resulting from your use of or inability to use the platform.


8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania and the applicable regulations of the European Union, without regard to conflict of law principles.
